1 Flexible forms of work performance Abstract This diploma thesis concerns the topic of flexible forms of work performance, which is very relevant in today's era of rapid technological progress and changing labour market. Its aim was to describe those institutes of flexible work performance that are regulated by the Labour Code, as well as to consider each institute's advantages and disadvantages and to offer a view on the possible development of labour law. The considerations de lege ferenda are based on the identified practical shortcomings of the current legislation and the direction of the European Union, which to some extent determines the image of the domestic legal order. Part of the thesis is devoted to a brief introduction of several basic concepts essential for understanding further interpretation of flexible forms of employment. Furthermore the text focuses on the activities of the European Union and especially those of the Court of Justice. In particular it describes its fundamental doctrines concerning the direct effect of directives. In this context, the thesis presents two relatively new directives, which should have already been implemented into our legal system. Flexible Forms of Employment

Flexible forms of employment This diploma thesis deals with the flexible forms of employment as an alternatives to regular form of employment. The focus of the first two chapters is to determine the basic terms regarding the topic of this thesis; the following chapter concentrates on the flexible forms of employment regulated by Czech law in particular, i.e. Fixed-term contract, part-time job, homeworking, agreements on work carried out beyond employment and agency employment. In the scope of introduction of the particular flexible forms of employment this thesis in detail deals with the Czech law regulation of these forms of employment and follows up their benefits and drawbacks to the parties of the before mentioned agreements. The thesis briefly mentions some legal issues besides the labor law, especially the issues from fields of the social security law and the tax law.
Atypical forms of employment

This diploma thesis focuses on atypical forms of employment, which have recently been frequently discussed also in the Czech Republic. Popularity of atypical forms of employment is increasing, because employees want better balance between family and work life. Thesis presents various trends in employment such as flexibility, which is described regarding the European Union policy and labour law principles. It also includes a historical excursion into the emergence and functioning of the phenomenon of flexicurity and explains the concept of work-life balance in terms of its use within the Czech Republic. The core part of the diploma thesis revolves around two atypical forms of employment: employee sharing and job sharing. It explains their functioning, maps their occurrence in the Czech Republic and appreciates their advantages and disadvantages. Also portrays how employee sharing is regulated and works in the Federal Republic of Germany along with usage and legal means of job sharing in the United Kingdom. Diploma thesis is concluded by suggestions for legal regulation and application of employee sharing and job sharing in the Czech Republic based on the evaluation with the German and British regulations. Strategy of Flexicurity in the Termination of the Employment contract in the Legislation of the Czech Republic and the Kingdom of Sweden

The thesis deals with the concept of flexicurity and its effects in the termination of the employment contract in the Czech Republic and the Kingdom of Sweden. The main aim of the thesis is to describe and compare both legislations from flexicurity perspective and suggest changes in the czech legislation. Strategy of flexicurity is one of the most discussed topics not only in the field of labour law but also in the field of social security systems and active labour market policies during the past few years. The concept of flexicurity can in a simplified way be characterized as a policy approach that tries to combine the flexibility of labor markets and job security for employees. According to the experts, flexicurity could help solve issues such as globalization or effects of economic crisis and higher unemployment occured due to the crisis. The thesis is composed of five chapters, each of them dealing with different aspect of the concept of flexicurity and its application in the Czech Reoublic and the Kingdom of Sweden. Flexicurity and her impact on competitiveness

In this theses I explain the concept of flexicurity aplied in the conditions of Czech Cepublic. The main goal was to explain the impact of flexicurity on competitiveness in the social and economic framework of Czech Republic. The main topics are labour market processes, social protection and lifelong learning strategy as 3 main pillars of flexicurity working togehter to fight unemployment and support employment and labour market flexibility, to ensure a right mix of social protection for people.
